Hendrickson, 576 U.S. 389 (2015) A pretrial detainee’s encounter with corrections officers resulted in injuries and led to an encounter at the Supreme Court over the correct standard for excessive-force cases in Kingsley versus Hendrickson. Michael Kingsley awaited trial in a county jail. Officers, including Stan Hendrickson, planned to move Kingsley to another cell. Kingsley didn’t cooperate, so officers forcibly handcuffed and moved him. Then, Hendrickson put his knee on Kingsley’s back. Hendrickson instructed another officer to tase Kingsley. Kingsley brought Section 1983 claims against Hendrickson and the other officers, alleging excessive force in violation of the Fourteenth Amendment’s Due Process Clause. The officers didn’t dispute that their actions were done purposefully or knowingly. At trial, the judge instructed jurors to decide whether Hendrickson used unreasonable force and acted recklessly. The judge also asked jurors to consider whether Hendrickson believed there was a safety threat. The jury returned a verdict for Hendrickson. Kingsley appealed, arguing that the judge incorrectly instructed the jury because an objective standard applied. The Seventh Circuit affirmed, reasoning that the claim required a subjective inquiry into Hendrickson’s state of mind. The United States Supreme Court granted cert. Want more details on this case?
