Around 7:02 PM on December 8, 2023, officers with the Rio Rancho Police Department arrived at the scene of a rollover crash involving a pickup truck on Unser Boulevard NE between Northern Boulevard NE and Abrazo Road NE. Police had been advised by another caller that the driver who struck the pickup truck was fleeing the scene in an Infiniti and that they were following them. Sergeant David Munoz started from the Rio Rancho Police Department towards the calling party who was following the vehicle, and he eventually located an 2014 Infiniti Q60 with a missing front bumper and he stopped the vehicle on Northern Boulevard NE near Sioux Drive NE. Once the vehicle was stopped, Sergeant Munoz approached the vehicle and made contact with the driver, who was identified as 21-year-old Isabella. As he was speaking with the driver, Sergeant Martinez detected the odor of alcohol and observed other indicators of impairment. Sergeant Jaclyn Martinez arrived on scene to conduct a DWI investigation. Isabella told Sergeant Martinez that she had attended a party with her coworkers since she worked as an orthodontic assistant. Based on her suspicion of impairment, Sergeant Martinez asked Isabella to perform field sobriety exercises. After some hesitation, Isabella eventually agreed to perform the field sobriety exercises. Sergeant Martinez started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Sergeant Martinez observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second field sobriety exercise was the Walk and Turn test. During this exercise, Isabella failed to touch heel-to-toe on each step and stepped off the line multiple times. The third field sobriety exercise was the One Leg Stand test, and Isabella did not raise her foot in the proper fashion and failed to keep her arms at her sides. The fourth exercise was the recitation of the alphabet from “C” to “R,” but Isabella recited the alphabet from “D” to “R” instead. The final exercise involved counting backwards from 72 to 51, and Isabella failed to count in the correct backward sequence. Isabella was asked to submit a breath sample for a portable breath test, and the results indicated a BAC of 0.14%. Based on the motor vehicle accident, her incoherent statements, her inability to adequately complete the field sobriety exercises, and the results of the PBT, Sergeant Martinez placed Isabella under arrest for driving under the influence. Sergeant Munoz conducted a search of her vehicle and found open containers of alcohol. Isabella’s vehicle was impounded by Boss Towing and she was transported to the Rio Rancho Police Department for initial processing. At the Rio Rancho Police Department, Sergeant Martinez read Isabella the New Mexico Implied Breath Consent advisory form, and she agreed to submit breath samples. Sergeant Martinez administered the Intoxilyzer machine after Isabella completed the 20-minute observation period. Her Intoxilyzer results indicated a BAC of 0.15% and 0.16%, which were over the legal limit of 0.08% for drivers over the age of 21. After Isabella was processed at the Rio Rancho Police Department, Officer Whitten transported her to Rust Medical Center for a medical clearance. Following her examination by hospital staff, Isabella was turned over to Sergeant Martinez, transported to the Sandoval County Detention Center, and booked for DWI.
