AI can be a powerful tool to complete background checks on prospective clients. This input can be used to identify potentially problematic prospects before they become clients. At this pre-client stage there is no ethical obligation for a practitioner to continue representation. For existing clients contemplating asset transfers an AI background check can be a valuable part of the pre-transfer due diligence process. This data can be used to identify potential claims or other issues that might suggest that the transfer not be consummated. With a strong due diligence file if a claimant later asserts that the transfer was a fraudulent conveyance the background check might help demonstrate that there were no known or identifiable issues. When can’t you use background checks? Employee and residential tenant vetting may be impermissible. Using multiple AI models to fact check searches and reduce risks of hallucinations.
