Video Transcript: Today I'd like to talk to you about marriages, green cards, and divorce - in that order. Let's say you married your U.S. citizen spouse and your U.S. citizen spouse petitions for a green card for you and you obtain a green card. Unfortunately, after that, you become divorced and your marriage dissolves. What happens to your green card then? The answer is that it depends. It depends on what type of green card you were issued. If you were issued a ten-year green card, then it's highly unlikely that the divorce would impact your green card. However, if you were issued a two-year green card - we call it a conditional green card - then the divorce could impact your green card. As I mentioned in a previous interview, if you have a two-year green card, you have to file form I-751 with the immigration service requesting the removal of the conditions on your green card. Typically, you would file the form with your U.S. citizen spouse, however, if you're divorced, you would file on your own and you would request a waiver based on divorce. The U.S. Immigration Service does require a significant amount of information; they will scrutinize your marriage more if you got married and then divorced within two years.
