Nonetheless, since nineteen twenty-one, every Supreme Court justice has voted, at least once, to overrule precedent. Dobbs versus Jackson Women’s Health Organization is another instance in which the Court overruled its own precedent. Jackson Women’s Health Organization, an abortion provider, and one of its doctors, brought a federal court action challenging a Mississippi law prohibiting abortions after fifteen weeks of gestation, on the ground that the law unconstitutionally infringed on a woman’s right to an abortion as established in Roe versus Wade and Planned Parenthood of Southeastern Pennsylvania versus Casey. The federal district court granted summary judgment for the plaintiffs and permanently enjoined the law’s enforcement. The Fifth Circuit affirmed. The United States Supreme Court granted cert.
