Supreme Court Has Let Down the Constitution in J&K Case, Says Former Home Secretary

One of the most highly regarded former Home Secretaries, Gopal Pillai, says that by failing to take a clear position on whether demotion of Jammu and Kashmir from statehood to union territory was constitutional or unconstitutional, the Supreme Court has failed in its duty to uphold the constitution. Mr. Pillai said: “Specifically in this particular case, the Supreme Court failed in its duties, failed to uphold the constitution which it is expected to protect.” Mr. Pillai also called this “an abdication by the Supreme Court of its duties.” In a 29-minute interview to Karan Thapar for The Wire, Mr. Pillai, who is also Co-chair of the Forum for Human Rights in Jammu and Kashmir, has called for “the immediate and full restoration of statehood to Jammu and Kashmir in the monsoon session of Parliament.” In the interview, he dismissed all the arguements that are likely to be made by the Modi government. These include the claim that the time is not right for the restoration of statehood, that terror remains a serious concern and that statehood could be restored in stages. Mr. Pillai’s organization the Forum for Human Rights in Jammu and Kashmir has also petitioned MPs for an amendment to the constitution to guarantee that in future no existing state can be demoted to union territory.
