So, a sole representative of an overseas business visa is a visa with which you can work in the UK. It is not under the Points Based System but it is basically for an individual who wants to come to the UK to establish a branch or a subsidiary of a parent company whose primary position or the primary establishment is outside the UK, or it is for an employee or a news agency or a broadcasting agency [and] who has been sent here on a long term assignment. Q2 - What Is The Eligibility Criteria? So, to be eligible for a sole representative of an overseas business visa you first need to be employed by the parent company and you need to be employed outside the UK. You need to be at a senior position in the company - you need to be at a position where you can make decisions on behalf of the company without having to refer everything back to them. Basically, once you come to the UK you should be able to make decisions for the company without having to ask the parent company for every small thing. Also, you cannot hold any shares in the company, rather, even if you hold shares, it's fine but you cannot be a majority shareholder in the company (the parent company, basically). [And] these are a few of the things that I can tell you about but there's a whole list of eligibility criteria for this particular visa. Q3 - What Documents Are Required? With regards to the documents - firstly you need documents to show that the company has an established presence outside the UK. So, these could be tax-related documents or these could be the registration documents from the company - lots of documents can be provided. Along with that you also need to provide an affidavit from the company, wherein they confirm that their intention is to send you (or the applicant) to the UK to basically establish a branch of a subsidiary here. They also need to confirm that you would have the authority to make decisions on behalf of the company in the UK. As the person who is applying for this visa, so the applicant, the applicant also has to confirm in an affidavit that basically their intention is to come to the UK only to establish a branch of the parent company and they do not intend to work anywhere else. So, these are a few of the documents that need to be supported but again, there's a whole list. Q4 - What Are The Requirements For Extending The Visa? So obviously once you come into the country and you've spent a certain amount of time here - before that visa expires you can extend your visa in the UK. [And] to extend this visa, at the time of application you might have given them a business plan so the Home Office would have a business plan about what you intend to do with this branch in the UK. What you need to show is you have actually established a branch or a subsidiary of the parent company in the UK and that it is up and running basically - and you need to give them documents to prove that as well. This is one of the main requirements for an extension application. Q5 - Does This Visa Type Lead To Settlement In The UK? Yes, this Visa type does lead to settlement in the UK, so initially when you're granted this visa you will be granted leave for 3 years and before the expiry of this leave you could apply for an extension in-country and the extension would be for 2 more years. So, once you complete 5 years in the UK you can apply for what is called Indefinite Leave to Remain.
