Thank you for asking me “How can my smart phone be used against me as Evidence”? First off, you should know that your cell phone is a potentially damning piece of evidence that can be used against you in court. “Cellular forensics” is an established science whereby a ton of data is extracted from your mobile device, analyzed, preserved and then tendered as evidence in Court. A small sampling of things that a cellular forensics expert can retrieve from your smart phone include contact lists, call histories, text messages, multimedia messages, internet browser histories, instant messages, pictures, videos, GPS coordinates and App histories... and in many - if not most - instances, a cellular forensics expert can mine this information from your smart phone whether it exists in the moment, even if you’ve deleted it, and sometimes even without the actual phone. Because of today’s smart phone capabilities and due to cellular forensics expert’s use of specialized hardware and software your mobile phone is very much like your “digital DNA” (in fact “digital DNA” is bona fide terminology). Like any other form of evidence, in order for your cell phone data to be admitted into your criminal case 1) it must’ve been lawfully obtained (meaning not illegally acquired), 2) it’s subject to authentication (meaning that whoever is trying to admit it has to first lay the proper predicate) and 3) it has to be relevant (meaning that it’s gotta tend to prove or disprove a material fact in the case).
