How can I get my Gun back from the Police? Any time that the police impound evidence - whatever it may be, a gun, a computer, a phone, a car, cash - they have to make a decision. Either they place an evidentiary hold on the property (which means that the cops believe the item to be of evidentiary value to the case), or they can file a claim for forfeiture of the property (which means that they’re holding it while they litigate in civil court in an attempt to make your property theirs by acquiring legal right or title to it) or the property is simply impounded incident to arrest and the cops have no hold on it at all. In the last case, where property is simply impounded incident to arrest and there’s no hold, the police may simply return it to you, but in either of the other cases, and perhaps here too, you’ll have to wait for, and possibly even fight for, a Court Order to get your property back. If a gun has evidentiary value then you can’t get it back until after the case has been resolved, and even then you’re gonna have to file a motion with the court seeking return of the firearm, and you’re gonna have to notice both the state and the police agency of the hearing. In the case of a gun you won’t get it back unless you can prove both your right to return of the gun and also your right to possess the gun, and if you fail to prove either ownership or a possessory right, then you won’t be getting that gun back. And if the government is seeking forfeiture then you have the additional hurdle of successfully litigating the civil forfeiture proceeding before taking the matter to your criminal court judge for approval.
