The Sri Lankan Constitution sets out the manner in which a suspect should be arrested and the proper legal procedure that must be followed when producing a suspect before a court of law. The procedural law relating to taking a person into custody is contained in the Code of Criminal Procedure Act. When arresting a suspect, the charge against him must be informed to him. If he does not submit to the arrest, he may be arrested by physically touching his body. If the suspect offers resistance or attempts to evade arrest by fleeing, the law provides that reasonable and necessary force may be used against him. However, when arresting a suspect, no force in excess of what is reasonably necessary may be used. Causing injury or harm to a suspect does not amount to the use of minimum force.
