In Penal Code 191.5(a), California law defines gross vehicular manslaughter while intoxicated as causing a traffic collision, while you're under the influence of alcohol or drugs or both, under circumstances where you exhibit 'gross negligence' or extreme recklessness in your driving. To prove their case in court, the prosecutor must establish more than simply that you were DUI and caused an accident where someone was killed. The state must prove that you drove with a wonton disregard for the safety of others. Examples would be driving 70 MPH on the surface streets, blowing through stop signs and red lights, or weaving in and out of lanes while tailgating other cars at high speeds.
