Lawyer Sisa Namandje has labelled the state's case in the unfolding NAMCOR corruption saga as one that is extraordinarily weak and accused the ACC of arresting Malakia and Peter Elindi before properly assessing the strength of its case. During cross-examination of lead investigator Oberty Inambao in the Windhoek Magistrate's Court, Namandje said the ACC acted hastily and arrested the Elindi brothers while its "house was not in order". Namandje further claimed that his clients had been charged under legal provisions that do not exist in the Anti-Corruption Act. He told Inambao to "accept that he is wrong" for laying charges that, according to the defence, have no legal basis. Inambao admitted that there was a possibility that a mistake may have been made in formulating some of the charges. Namandje responded by stating that the ACC was calling a mistake a strong case. Defence lawyer Sisa Namandje told the court that Inambao was a danger to his own case. Inambao also said some of the evidence he placed before the court has not been verified. Namandje made the remarks during cross-examination in the ongoing bail hearing of the accused in the NAMCOR corruption case, where brothers Peter and Malakia Elindi are among the central figures. Namandje disputed the State's claim that Namcor Trading was misled by the Elindi brothers when it purchased assets from Enercon, a company linked to the accused. The prosecution alleges that the brothers sold fuel assets that did not belong to them. Namandje argued that NAMCOR made a formal offer to purchase the assets, saying there was no misrepresentation on the part of the Elindi brothers. Inambao earlier told the court that Enercon sold assets that were never legally theirs to sell and that this formed part of a scheme to misappropriate millions from the state-owned petroleum company. He said the funds were later distributed among various entities linked to the accused.
