By: Matheus Envaalde Investigations conducted by the Anti-Corruption Commission (ACC) show Immanuel Mulunga and Jennifer Hamukwaya, both accused in the Namcor corruption case, did not receive direct payments from Enercon. ACC chief investigator, Orberty Inambao, told the Windhoek Magistrate Court on Monday that, while no direct payments were made into their personal accounts, both Mulunga and Hamukwaya played key roles in facilitating improper fund transfers linked to the N$53 million Namcor–Enercon deal, bypassing due process. Inambao explained that Hamukwaya used her authority to approve debts within the Namcor–Enercon deal, which enabled funds to be improperly routed to her husband’s company, Panduleni Farming. “The fact that there is no evidence or there's no money which went into the account, I mean the accused person's account, does not rule them from having committed the offences.” Inambao said the conspiracy dates back to October 2021, supported by evidence from an Enercon resolution that granted Hamukwaya access to the account. "There's no rationalisation whatsoever that was provided. Thereafter we know that Enercon was given initially a limit of five million which was cancelled by Ms. Hamukwaya and thereafter fuel supply agreement was entered, in fact before the fuel supply agreement was entered into." Inambao further clarified that during the arrests, phones were seized under urgent legal provisions permitting warrantless searches to prevent suspects from evading justice, especially as phone calls between the accused had been detected. "We detected or noticed that there were calls that were made to amongst others the gentleman who's currently out of the country or rather who's fleeing from justice. Hence the decision was taken because that was the very very first day that we started arresting. In fact it was within a couple of hours if not minutes when Ms. Hamukwaya was apprehended and so was Mr. Mulunga.” "So the law does make provisions for us as investigative authorities to seize articles without a search warrant,” said Inambao.
