During an emergency, the Federal structure of India assumes a unitary character, allowing swift and coordinated action. The Indian Constitution defines "Emergency" in Part 18 (Articles 352-360) as situations where extra ordinary measures are taken to ensure national stability. The Indian Constitution provides for three types of emergencies :- 1) National Emergency (Article 352), 2) State Emergency/ President's Rule (Article 356), 3) Financial Emergency (Article 360). आइए इन तीनों प्रवधानों को एक-एक कर विस्तार से जानें:- ➡️ National Emergency : It can be proclaimed when the security of India or any part thereof is threatened by war, external aggression, or armed rebellion. 📍Must be approved by both Houses of Parliament within one month. 📍The Federal structure becomes unitary - the Centre gains control over the States. 📍Fundamental Rights under Article 19 are automatically suspended. 📍The President can modify the distribution of revenues between the Centre and States. 📍It continues for six months and can be extended with Parliamentary approval. ✒️ Historical Use:- INDIA has experienced National Emergency three times - 1962, 1971, and 1975. The 1975 Emergency raised serious concerns regarding misuse of power leading to important Constitutional safeguards later. ➡️ State Emergency/ President's Rule (Article 356). State Emergency is imposed when the constitutional machinery in a state fails to function according to the Constitution. 📍The President can assume all or any of the function of the State Government. 📍Parliament exercises the powers of the State Legislature. 📍Initially valid for 6 months, and can continue up to 3 years with Parliamentary approval. 📍Often criticized for misuse for political purposes.(e.g., S.R. Bommai vs. Union of India, 1994), the Supreme Court held that the President's proclamation under Article 356 is subject to Judicial review, thereby preventing arbitrary use. ➡️ Financial Emergency (Article 360) : A Financial Emergency may be proclaimed if the financial stability or credit of India or any part thereof is threatened. 📍Parliament gains overriding powers. The Union can issue directions to States regarding financial matters. 📍Salaries of government servants, including judges, may be reduced. 📍Ensures continuity of government during crises. 📍To date, Financial Emergency has never been imposed in India. 👉 Impact on Fundamental Rights During National Emergency: During National Emergency, certain Fundamental Rights may be suspended. However, after the 44th Constitutional Amendment Act, 1978, Article 20 and 21 (protection of life and personal liberty) cannot be suspended under any circumstances, strengthening civil liberties. 👉 Significance : 1) Ensures national security and stability. 2) Enable coordinated action during crises. 3) Protects Constitutional governance. 👉 Criticism : 1) Potential misuse of power, especially Article 356. 2) Curtailment of democratic freedoms during emergencies. 3) Risk of excessive centralization. 👉 Conclusion: Emergency provisions play a crucial role in preserving the unity and integrity of India during extraordinary circumstances. While they grant wide power to the Union, Constitutional amendments and Judicial interpretations have introduced essential safeguards to prevent misuse.
