Thank you for asking me “What is Electronic Evidence”? Evidence comes in many forms and can be categorized in many ways. For instance evidence can be direct, circumstantial, physical, testimonial, scientific and so on... but when we use the term “electronic evidence” we are referring to anything that can be stored or transmitted in a digital form and later be introduced in a trial. Commonly used forms of electronic evidence include such things as e-mail, social media account histories, posts or comments, digital photographs, surveillance footage, ATM transaction logs, any file or document on a computer - like a word processing file or a spreadsheets, internet browser history, computer, smart phone or tablet memory content, backups, printouts, GPS tracks and logs, App histories, digital video or audio files, “black box” information from cars or planes, and even things like the log from a hotel’s electronic door locking system. All of these things, and basically anything that is either “digital” or electronic is potential electronic evidence. Like any other form of evidence, in order for electronic evidence to be admitted into your criminal case it 1) must’ve been lawfully obtained (meaning not illegally acquired), it’s 2) subject to authentication (meaning that whoever is trying to admit it has to first lay the proper predicate) and it 3) has to be relevant (meaning that it’s gotta tend to prove or disprove a material fact in the case). The bottom line with electronic evidence is that every time you use a computer, smart phone, tablet or other electronic device, and every time that you post or appear or are tagged in social media, and every time that you pass through a toll booth or under a traffic camera and in any of an uncountable number of other ways, electronic evidence that could potentially be admitted into evidence against you is being generated.
