Partner with Banker's Compliance Consulting AML/CFT Group: https://bit.ly/BSA-AML-CFT Kevin discusses different levels of violations that can occur in a regulatory environment, including: 1. Pillar violations, which are fundamental flaws in key elements and result in an automatic cease and desist order. 2. Systemic and recurring violations, which are broader, systemic problems or issues that have been previously identified but not corrected, and can also lead to a cease and desist. 3. Isolated and technical violations, which are less severe and can be addressed over time, as long as they are not too frequent. 4. Recommendations and best practices, which are not legal requirements but suggest better ways of doing things. The organization should document whether they will implement these recommendations or not, and why. The key is for the organization to understand the varying levels of violations, address them appropriately, and document their risk-based decisions, even for recommendations that are not directly required by law.
