Delivery of Judgment - GYCV2025/001 Satyanand Persaud & Another v Dhavanie Persaud & Another

Judgment will be delivered in this appeal in which Satyanand Persaud and Taij Bahadur appeal a decision by the Court of Appeal of Guyana, denying them leave to appeal against a ruling of the Full Court. Although the appeal is limited to a review of the Court of Appeal’s refusal of leave, underlying the case is Satyanand’s claim that the estate of his late brother, Shamsundar Persaud, owes him US $400,000. Satyanand had obtained a consent judgment from the High Court for that sum, but that judgment was subsequently and summarily set aside by another High Court judge, whose decision the Full Court upheld. Representing her father’s estate and herself, Dhavanie Persaud, Shamsundar’s daughter and the appellants’ niece, is the respondent. The appellants argue that the Court of Appeal erred by refusing to extend the time within which they may apply for leave to appeal, and by denying leave. They seek either leave to appeal to the Court of Appeal or a remittal of the matter to the High Court for a trial.
