WHERE IT TAKES PLACE: Maricopa County, Arizona, about 14-15 miles west of Phoenix, near what became Sun City. THE STORY: 1. Spur ran a large cattle feedlot in a rural/ag area. 2. Del Webb built a retirement community (Sun City) and expanded toward the feedlot, then buyers/residents complained about odors/flies, and sales got harder. 3. Webb sued to shut Spur down as a nuisance. THE RULE & HOLDING: 1. The court said the feedlot could be enjoined as a public nuisance (especially because Arizona law treats breeding places for flies/mosquitoes in "populous areas" as public nuisances). 2. But because Webb essentially "came to the nuisance" by building the community toward Spur, the court crafted an equity solution: Webb must indemnify Spur for the reasonable costs caused by the injunction (moving/shutting down).
