I wasn't able to watch the trial, and just talked from the limited information I had which included the docket. I had warned that I thought Jose "Chille" DeCastro was likely to be convicted on both counts. These are hard and vague charges to beat, and I've analyzed the Nevada Statutes and over 200 cases regarding their Constitutionality, and where the Nevada Supreme Court has ruled them Constitutional precisely due to officer safety I said the DA would push. The trial was faster than I expected, and I also expected more witnesses. Instead, it was a fast trial and Chille got more jail time than I expected. According to the docket he was convicted on both counts, and I am told that he received two 90 day jail sentences, to run consecutively. I pulled the docket and will give my input. The sentence is harsh compared to typical defendants. The judge gave mid-range sentences to avoid losing on appeal, and surprisingly (to me), strung them together. If Chille violates any terms of probation, he faces additional time for the violation, and could return to jail. We don't know what the judge relied on in sentencing him, but usually the sentencing is delayed. I'll view the Our Nevada Judges filming of the trial when I have a moment, to break down what happened. Please subscribe to their channel and contribute your financial support. It takes money to do what they do, and they made this possible. None of this is legal advice, and always check with a local attorney that is licensed in your area to advise you of your legal rights.
